GENERAL TERMS AND CONDITIONS OF ONLINE SALE
LA PORTE NOIRE

1. Purpose
These General Terms and Conditions of Sale (GTCS) govern all bookings made online with La Porte Noire via the Regional Booking Tool (ORC).
The client acknowledges having read and accepted these conditions prior to any booking. No booking can be finalised without their acceptance.
The client may save and print these GTCS for future reference.
2. Offers
All our advertisements, offers and web pages are created in good faith based on the available information. Maps, photographs and illustrations are non-contractual and provided for illustrative purposes only.
We reserve the right to modify these elements before the booking is confirmed. The client authorises La Porte Noire to correct any obvious material error contained in the provided information.
3. Price
The prices displayed at the time of booking represent the total cost of the stay, including all taxes and mandatory charges. Any additional fees will be clearly indicated prior to the confirmation of the booking.
A security deposit of €300 is required at the time of booking. This deposit is intended to cover any potential damage, loss, or breach of the house rules. It will be held for the duration of the stay and refunded within 10 days after departure, provided the property is left in good condition and all keys and equipment are returned.
In the event of an obvious pricing error, La Porte Noire reserves the right to adjust the amount and notify the client as soon as possible.
4. Booking
The client selects the services via the Regional Booking Tool (ORC). They acknowledge that they have:
✔️ Familiarised themselves with the features and conditions of the booking.
✔️ Obtained all necessary information to make an informed reservation.
✔️ Ensured the suitability of the stay for their needs, without La Porte Noire being held liable in this regard.
Any booking is considered accepted upon completion of the confirmation process.
5. Booking Process
The booking is made using a digital booking form, accessible online. The booking is deemed confirmed upon receipt of the confirmation document.
The client agrees to provide accurate and complete information during the booking process.
The booking process includes the following steps:
1️⃣ Selection of desired services.
2️⃣ Entry of personal details and payment guarantee (if requested).
3️⃣ Review and acceptance of these GTCS.
4️⃣ Final validation of the booking.
6. Booking Confirmation
Once the booking is finalised, a confirmation email is sent promptly to the client.
This document includes:
📌 The contractual offer and the reserved services.
📌 The prices and applicable terms of sale.
📌 The booking date and the contact details of the establishment.
If the confirmation email is not received, the client is advised to check their spam folder or contact La Porte Noire.
7. Right of Withdrawal
📌 No right of withdrawal
In accordance with Article VI.53 of the Belgian Code of Economic Law, the client does not have a right of withdrawal when booking:
✔️ Accommodation for non-residential purposes (e.g. tourism, holiday rental).
✔️ Services related to transport, vehicle hire, catering or leisure activities, where the services are provided on a specific date or during a specific period.
As such, all bookings are final and may not be cancelled except under the cancellation terms stated at the time of booking.
8. Personal Data Protection
📌 GDPR compliance (General Data Protection Regulation – 2016/679)
Personal data collected is strictly necessary for processing bookings and managing the reserved services (legal basis: Article 6.1.b of the GDPR).
8.1. Use and sharing of data
Client data may be shared with:
✔️ Elloha.com, the booking tool manager.
✔️ Online payment providers and banks in the event of a secure transaction.
✔️ Other partners essential for the execution of the contract, including some located outside the European Union, provided they ensure GDPR-compliant protection.
8.2. Marketing communication
With their consent, the client may receive:
📩 Promotional offers and newsletters by email or post.
The client may unsubscribe at any time by sending an email to info@laportenoire.eu or by using the unsubscribe link included in each communication.
8.3. Data retention
Client data is retained for three years after the last contact (booking, email, call, etc.).
8.4. Client rights
In accordance with the GDPR, the client has the following rights:
✔️ Right of access – To obtain a copy of their data.
✔️ Right to rectification – To correct any incorrect data.
✔️ Right to erasure – To request the deletion of their data, under certain conditions.
✔️ Right to object – To refuse the use of their data for commercial purposes.

In the event of a dispute, a complaint may be submitted to the Belgian Data Protection Authority (www.gegevensbeschermingsautoriteit.be).
9. Amendments to the GTCS
La Porte Noire reserves the right to amend these general terms and conditions at any time.
The applicable GTCS are those in force at the time of booking, which the client has read and accepted.
10. Governing Law and Jurisdiction
📌 This contract is governed by Belgian law.
📌 In the event of a dispute, the competent courts shall be those of the registered office of La Porte Noire.
